Introduction
These terms and conditions govern all services provisioned by www.migservers.com and its associated corporate entities. Throughout this document, MIG servers may be referred to as the "Company." These policies apply to all clients, users, and recipients of our services (hereinafter referred to as "Subscribers"), regardless of their payment status. By accessing or utilizing our platform and services, you explicitly acknowledge and consent to the following terms:
1. Age Requirements and Restrictions
1.1 Legal Capacity: Any individual placing an order via the MIG servers online portal must explicitly warrant and guarantee that they are at least 18 years of age and possess the legal capacity to enter into a binding contract.
1.2 Underage Restrictions: If a Subscriber is discovered to be under the age of 18, they must immediately notify the Company and terminate all active services. Further use of MIG servers' infrastructure by such individuals is strictly prohibited.
1.3 Parental Consent: In instances where a client is under 18, explicit, verifiable consent from a parent or legal guardian is mandatory to access our platform or services. MIG servers fully disclaims any liability, legal complications, or consequences arising from a client's misrepresentation of their age.
2. Access Credentials, Limitations, and Prohibitions
2.1 Account Information: Accessing the MIG servers control panel requires the submission of personal data, which is securely maintained in our databases. Subscribers must ensure that all provided information is accurate, truthful, and complete. We reserve the absolute right to deny access if any data is found to be falsified, erroneous, or incomplete. Furthermore, we maintain the right to suspend or terminate services instantly—without a refund—if fraudulent activity is suspected.
2.2 Limited Usage License: Subject to these TOS, MIG servers grants you a limited, non-transferable, non-exclusive license to utilize our services for private and authorized commercial purposes only. Any unlawful use is strictly forbidden. Subscribers must actively prevent unauthorized access or misuse of their assigned services. We reserve the right to enforce network security protocols and bandwidth limitations. Any unauthorized use will result in the immediate revocation of this license and may lead to legal prosecution to the maximum extent permitted by law.
3. Know Your Customer (KYC) & Identity Verification
To ensure a secure, compliant, and reliable network, MIG servers enforces a strict and mandatory KYC policy.
3.1 Required Data: Subscribers must submit accurate details, including their Full Name, Email Address, Phone Number, Physical Address, Country, and Postal Code.
3.2 Verification Policies: Should our systems detect fabricated or inaccurate information, you will be granted a single opportunity to rectify the issue by submitting a valid, government-issued ID alongside biometric verification. While we operate globally, orders routed through VPNs, Tor networks, or Proxies will be automatically flagged and rejected.
3.3 KYC Failure & Refunds: In the event of KYC verification failure, refunds will strictly be issued only for transactions made via Visa, Mastercard, and American Express (Amex). Payments executed via Cryptocurrency, alternative payment gateways, or non-reversible methods are strictly non-refundable upon KYC failure. Intentionally submitting fake data or leaving KYC fields blank will result in a permanent account ban. Any funds within a banned account will be frozen permanently, with no refunds issued under any circumstances.
3.4 Data Privacy: MIG servers is fully committed to your privacy. Your personal information will be kept highly secure and will never be sold, leaked, or distributed to unauthorized third parties.
4. Billing, Subscriptions, Payments, and Refunds
4.1 Billing Cycle: Service deployment will only commence following the receipt of full payment. Invoices are generated and sent at least 14 days prior to the due date. Timely payment is the sole responsibility of the Subscriber.
4.2 Payment Methods & Overdue Balances: If an account holds an outstanding balance for more than 24 hours, MIG servers reserves the right to suspend or terminate services until the balance is cleared. Accepted payment methods include Credit Cards, Wire Transfers, Cryptocurrency (Bitcoin/USDT), and other verified gateways.
4.3 General Refund Policy: MIG servers does NOT issue refunds, except in scenarios explicitly covered by our Service Level Agreement (Section 11) or in the event of a verified billing error.
4.4 Automated Subscriptions: Payments made via Credit Card will automatically enroll you in an automated subscription. Renewal funds will be deducted automatically on the due date. We do not refund automated renewals. To prevent future charges, you must cancel your service via the client portal or submit a support ticket prior to the renewal date.
4.5 Set-Up Fees: Standard setup fees for dedicated bare-metal servers are waived, except in cases requiring custom third-party configurations.
5. Cryptocurrency AML & Compliance Policy
By utilizing cryptocurrency payments including Bitcoin (BTC), Tether (USDT), Ethereum (ETH), Litecoin (LTC), or any other supported digital asset for MIG servers services, you explicitly agree to the following Anti-Money Laundering (AML) and compliance requirements. These conditions apply to all new and existing customers without exception.
5.1 Prohibited and High-Risk Cryptocurrency Sources
MIG servers utilizes advanced real-time blockchain analytics and AML transaction monitoring systems to identify suspicious or prohibited cryptocurrency activity. We strictly prohibit and will not accept funds originating from, associated with, or linked to the following categories:
- Child Exploitation & Abuse: Any entities associated with child exploitation, child abuse material, terrorism financing, or drug trafficking operations.
- Darknet & Illegal Services: Cryptocurrency connected to darknet marketplaces, illegal online services, or criminal organizations.
- Cryptocurrency Mixers (Tumblers): Coins processed through mixers, tumblers, or obfuscation services designed to conceal transaction origins or laundering activity.
- Stolen Funds, Scams & Ransomware: Cryptocurrency obtained through hacking, phishing, fraud, extortion, ransomware, scams, or unauthorized wallet access.
- Sanctioned Entities: Wallets, exchanges, organizations, or individuals subject to sanctions, legal enforcement actions, or judicial investigations.
- Fraudulent Exchanges: Cryptocurrency exchanges involved in exit scams, illegal conduct, confiscated assets, or financial fraud investigations.
- Illegal Gambling: Funds associated with unauthorized or unlicensed online gambling operations.
- Terrorism Financing & Security Threats: Any entities flagged for terrorism financing, cybercrime, or critical international security threats.
- Unregulated Cryptocurrency ATMs: Cryptocurrency originating from loosely regulated ATM operators or cash-based crypto services with inadequate KYC procedures.
5.2 Enforcement Actions & Compliance Penalties
If our AML monitoring systems flag a transaction as suspicious, prohibited, or high-risk, MIG servers reserves the absolute right to immediately enforce one or more of the following actions without prior warning:
- Immediate Freezing of Funds: Suspicious cryptocurrency assets may be isolated and permanently frozen to protect our financial infrastructure.
- Strict No-Refund Policy: Blacklisted or high-risk cryptocurrency payments will never be refunded, credited, reversed, or returned.
- Immediate Service Termination: All associated servers, hosting services, virtual machines, and customer accounts may be instantly suspended or permanently terminated.
- Order Cancellation: Any pending, unpaid, or provisioning orders associated with the transaction may be cancelled immediately.
- Regulatory Cooperation: MIG servers reserves the right to cooperate with financial institutions, blockchain analytics providers, law enforcement agencies, and international compliance authorities where legally required.
IMPORTANT AML COMPLIANCE NOTICE:
This Cryptocurrency AML & Compliance Policy is mandatory and strictly enforced. By transmitting cryptocurrency to MIG servers wallets or payment addresses, you fully accept responsibility for the legality and origin of your funds. Any violation of this policy may result in frozen funds, permanent account termination, and law enforcement escalation without refund.
6. Provided Services
6.1 Bare Metal Servers: High-performance, dedicated server solutions featuring customizable processing power, RAM, and storage.
6.2 Colocation Services: Full-suite colocation facilities providing cabinet space, power, uplink connectivity, and IP allocations.
6.3 DDoS Mitigation: Advanced Level 3 ingress traffic filtering designed to neutralize Layer 1 through Layer 6 DDoS attacks.
6.4 IP Transit: Comprehensive global IP transit connectivity for our colocation clients.
7. Intellectual Property & Copyright
All materials, content, and infrastructure accessible via our network remain the proprietary property of MIG servers. We enforce a zero-tolerance policy against copyright infringement. You may not copy, transmit, modify, or distribute any of our website material without explicit written consent. Utilizing our services does not grant you any ownership or intellectual property rights over our infrastructure.
8. Acceptable Use Policy (AUP) & Unacceptable Activities
To preserve the integrity and security of our global infrastructure, MIG servers enforces a strict AUP. Using our network to host, transmit, store, or promote the following is expressly forbidden:
8.1 Network Abuse & Cybercrime
- IP/Header Forgery: Spoofing IP addresses, packet headers, or email headers to mask traffic origins.
- DDoS/DoS Attacks: Participating in, facilitating, or initiating Distributed Denial of Service attacks or network floods.
- Malware & C2 Servers: Executing, distributing, or hosting malicious software (ransomware, trojans, viruses) or operating Command and Control servers.
- Network Probing: Unauthorized vulnerability scanning, port scanning, or brute-forcing against our network or third parties.
- Phishing: Hosting fraudulent login pages, fake websites, or facilitating identity theft.
8.2 Illegal & Harmful Material
- Child Sexual Abuse Material (CSAM): Absolute zero-tolerance for hosting or distributing CSAM. Immediate termination and reporting to global law enforcement will follow.
- Extremism & Terrorism: Promoting violence, terrorist acts, or weapon manufacturing.
- Human Trafficking: Facilitating human trafficking or illegal prostitution.
- Illegal Substances: Distributing or promoting illegal narcotics, contraband, or unlicensed pharmaceuticals.
8.3 Financial Crimes & Fraud
- Carding: Storing, distributing, or selling stolen credit card data or leaked identity databases.
- Ponzi/HYIP: Operating fraudulent cryptocurrency platforms, pyramid schemes, or High-Yield Investment Programs.
- Fake E-commerce: Running deceptive business fronts to defraud buyers.
8.4 Spam & Email Abuse
- Unsolicited Commercial Email (UCE): Sending bulk Spam or operating mailing lists without verifiable opt-in records.
- Mail/SMS Bombers: Deploying scripts to overwhelm devices or inboxes.
- Blacklisting: Any action resulting in MIG servers' IPs being flagged on global databases (e.g., SORBS, Spamhaus).
8.5 Intellectual Property Violations
- Warez & Piracy: Distributing copyrighted media, keygens, cracks, or nulled scripts (e.g., nulled Windows, cPanel, WHMCS) without authorization.
8.6 Resource Abuse & High-Risk Activity
- Tor Exit Nodes: Running Tor exit relays that generate heavy abuse complaints.
- Open Proxies/Resolvers: Operating unsecured Open DNS resolvers or proxies vulnerable to weaponization.
STRICT ENFORCEMENT & ZERO-TOLERANCE PROTOCOL:
MIG servers actively monitors network traffic for abuse. If your account is found engaging in
any of
the aforementioned activities (including hosting illegal MP3s, warez, or hacker programs), your
service will be immediately suspended, wiped, or permanently terminated without prior notice or
refund.
Dark Web & Ransomware Notice: We maintain a strict Zero-Tolerance stance on Ransomware and Dark Web operations. If your server facilitates Ransomware, malicious Tor Exit Nodes, or Dark Web marketplaces, the server will be immediately seized. Your complete KYC data, IP logs, and connection history will be unconditionally surrendered to local law enforcement and international cybercrime units for prosecution.
9. Unpaid Invoices & Account Suspension
9.1 Equipment Collateral: For colocation clients, MIG servers reserves the legal right to assume ownership of colocated hardware if an invoice remains unpaid for over 30 days.
9.2 Breach Termination: Failure to pay on time or violation of any terms herein grants us the right to immediately suspend or terminate your service. Upon termination, MIG servers reserves the right to securely format and wipe all data on the server.
10. Setup and Upgrade Procedures
10.1 Upgrades: Requested service upgrades will take effect at the beginning of the next billing cycle unless the upgrade is paid for immediately in full.
10.2 Setup Timeframes: Standard service provisioning is typically completed within 24 hours. Provisioning times for dedicated bare-metal servers may fluctuate based on hardware inventory.
11. Cancellations
All cancellation requests must be formally submitted via a verified support ticket no later than 24 hours before the next billing due date. Submitting a cancellation acknowledges your liability for any charges accrued up to the termination date. MIG servers does not issue pro-rated refunds for mid-cycle cancellations.
12. Service Level Agreement (SLA)
MIG servers proudly guarantees a 99.99% network uptime. If we fail to uphold this metric due to internal network faults, you may qualify for service credits. Note that setup fees remain strictly non-refundable. Clients experiencing technical issues must immediately open a support ticket for resolution.
13. Limitation of Liability and Data Security (IMPORTANT)
13.1 Data Backups: MIG servers does NOT perform automatic data backups unless you have explicitly purchased a managed backup plan. The Subscriber assumes 100% responsibility for maintaining secure, off-site backups of all data hosted on our infrastructure.
13.2 Liability: Under no circumstances shall MIG servers, its employees, or directors be held legally or financially liable for data loss, hardware degradation, security breaches, hardware failure, lost profits, or indirect business damages resulting from the use or inability to use our network.
14. Force Majeure
MIG servers shall not be held liable for any delay or failure in service provisioning if such disruptions are caused by events beyond our reasonable control. This includes, but is not limited to, natural disasters, acts of God, global internet outages, power grid failures, government restrictions, acts of terrorism, or war.
15. Amendments to Policies
MIG servers reserves the right to modify or amend these Terms of Service at our discretion. Updates will be enforced immediately upon being posted to our website. Your continued use of our services following any policy change constitutes your binding acceptance of the updated terms. If you do not agree with the new amendments, you must submit a cancellation request and terminate your usage immediately.
16. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes, claims, or legal proceedings arising in connection with these terms shall be subject to the exclusive jurisdiction of the state and federal courts located within the United States.
